3541.2 Use of Transportation Equipment


The general philosophy of the Board of Education is that transportation equipment purchased by the District is to be used primarily for school purposes and that tax payers shall not be expected to subsidize busing equipment or personnel not necessary for school district purposes.

The Superintendent shall determine the hours and days when school district transportation equipment is available for use by non school groups. Said decision shall insure that the times available for such non school use shall not interfere with:
a. transportation to and from school.
b. transportation between schools.
c. transportation for school activities and functions.
d. transportation necessitated or anticipated for school emergencies.
e. time required for maintenance and service.
f. time necessarily involved to provide standby equipment for school purposes.

The following criteria shall apply in the use of transportation equipment:

A. Transportation equipment may be used for school age children or for residents over the age of 65 years without charge or for such reduced charges as may be determined by the Board or Superintendent for bona fide, general, recreational or educational purposes. The activity involved must be open and available to qualified persons generally, although obvious, nondiscriminatory differences considering the activity contemplated, are allowed. If sponsored by a sectarian, private or politically oriented organization the activity may not be used in any way for the furtherance, education or propagation of the beliefs or points of view of the sponsor.

B. Transportation equipment may be used by other groups, public and private, for any reasonable purpose so long as no commercial carrier is willing and able to provide the service, despite differences in cost. In such cases the user shall reimburse the District all of its reasonable expenses, including fixed costs.

C. The general criteria to cover both classes of use (A and B) enumerated on Page 1 are:
1. No use by groups of less than 5 shall be approved.
2. Insurance coverage (provided by the users - provided bythe district) shall be in effect during time of any such use, with similar coverage and limits not less than insurance coverage carried by the district for transportation of students.
3. No use shall be approved which involves travel over roads or distances which are unduly wearing or damaging to the equipment or for which equipment construction is inappropriate.
4. Use shall not be approved if the fuel consumption involved adversely affects the fuel availability for school district purposes.
5. Any approval of use shall be subject to cancellation in the advent of adverse roads, weather, or other conditions which could reasonably present a danger to passengers, drivers or equipment or in the event of unexpected or emergency school needs.
6. Use shall not be approved unless some individual identifies himself as coordinator or leader of the group and agrees to assume responsibility for collection and remittance to the district of the required reimbursement.
7. Use shall be not approved it if is for partisan political activities, activities promoting or opposing sectarian views, activities which are potentially disruptive or dangerous.
8. All use shall be subject to the availability of appropriate equipment and personnel. The Superintendent may impose such requirements as are deemed necessary, relative to supervisory personnel accompanying any groups utilizing transportation equipment.
