The teachers of this District expressed their desire, through a formal election, to have the Moffat County Education Association exclusively represent them in professional negotiations. Under the conditions described below in this Policy Resolution, the Board of Education of Moffat County School District Re: 1 hereby recognizes the Moffat County Education Association as the exclusive representative of all persons eligible for including in the negotiating unit in matters pertaining to salaries, related economic conditions of employment, and the establishment of procedures for the processing of grievances relating thereto.
This present recognition and all subsequent recognitions shall be consistent with the following policy, and the exercise of all rights and privileges of recognition shall be subject to the terms, conditions, and procedures set forth in this Board Policy.
Recognition:
The recognition of the Moffat County Education Association, on the basis of the election already conducted, shall remain in effect until October 31, 1974. Not less than 90 days prior to the date set for the expiration of recognition, the Board shall adopt such policy as may be deemed appropriate pertaining to the continued recognition of an organization as the exclusive representative of an employee group.
Negotiating Unit:
Eligibility for inclusion in the negotiating unit is and shall be limited to persons whose employment in the District requires that they possess a valid certificate issued or recognized by the State Board of Education, except those persons on Per Diem appointment, and persons holding positions designated by the Board as administrative or supervisory.
Negotiations - Scope and Procedures:
Following the granting of recognition to an organization, pursuant to provisions of this Policy, the designated representatives of the Board shall meet with representatives of the recognized organization to negotiate and attempt to reach agreement on matters of salaries, related economic conditions of employment, and procedures for the processing of grievances relating thereto when it is alleged that a relevant policy of the District has been violated or misinterpreted.
Ratification of Negotiated Agreements:
Final ratification by the Board shall be withheld pending determination that the funding of the provisions agreed upon may be incorporated into a budget which may be adopted and approved within the limitations of law.
General Provisions:
1. In the adoption of this Policy, the Board hereby agrees to abide by the following, and any organization recognized or seeking to be recognized pursuant to provisions of this Policy shall also be committed to abide by the following:
a. All employees of this District shall have the right to join or participate in any organization of their choosing which is compatible with the laws of Colorado; and they shall have the right to refrain from joining or participating in the activities of any such organization.
b. Neither the Board of Education nor any of its employees nor any person or organization shall interfere with, restrain, coerce, or discriminate in respect to any employee either engaged in or refusing to engage in activities relating to the application of provisions of this Policy.
2. No person may be required to pay dues to an organization, or a fee in lieu thereof, as a condition of employment in this District.
3. In the adoption of this Policy, the Board hereby declares that nothing contained herein is intended to be so construed as to delegate or limit the powers, duties, discretions, or responsibilities of a Board of Education as prescribed by the Constitution and Laws of the State of Colorado. If any provision of this Policy or any application of this Policy shall be found contrary to law, such provision or application shall have effect only to the extent permitted by law.
4. The Board hereby declares that nothing contained in this Policy is intended to be so construed as to prohibit or limit any individual or organization, subject to such reasonable rules and procedures as the Board may from time to time adopt, from appearing before the Board on matters of school district policy.
