Sick Leave

Sick leave will be allowed at the rate of nine (9) days per year for licensed staff and as per Regulation 4161.1 for classified employees, accumulated to one hundred twenty (120) days.

Sick leave may be used for the following purposes:

1. For illness in the family as well as personal illness.
2. For purposes of adoption.

Extended Sick Leave

Effective thirty (30) days after the first day of regular employment, district employees may be allowed extended sick leave pursuant to the following policy.

Extended sick leave will be limited to fifteen (15) days per year per employee and will be used only in the event of extended illness or long term disability. Extended illness is defined as follows:

1. An illness that lasts for at least five (5) consecutive working days and that occurs after the employee has exhausted all of the employee's sick leave, and;

2. A disease or ailment of such a character as to affect the general soundness and healthfulness of the employee in a serious manner and is not a mere temporary disposition which does not tend to undermine or weaken the constitution of the individual.

Any extended illness shall be certified by the employee's doctor on forms provided by the district.

An elective medical procedure shall not be considered an extended illness. Complications arising from such procedures will be covered under extended sick leave.
Procedures for application for extended leave are as follows:

There is hereby created an extended leave committee charged with the administration of extended leave, which committee shall consist of one (1) administrator, one (1) teacher, one (1) classified employee and the director of personnel. The superintendent and the president of the Moffat County Education Association are jointly charged with the responsibility of appointing and posting the committee by no later than the first day that teachers commence a teaching year. The responsibility of the extended leave committee shall be to act upon any application for extended leave and to determine whether the affected employee is eligible for such leave.

1. Application forms, including the form for the doctor's certification, can be obtained from the district's business office and should be returned to said office.

2. The application for extended leave must be made within five (5) days of expiration of the employee's sick leave as described above.

3. The extended leave committee will act upon the application. If an employee wishes to appeal the decision of the committee, he/she may do so by presenting his or her case to the board of education at the next regularly scheduled meeting.

4. Any extended sick leave days granted shall be retroactive to the day of expiration of accumulated sick leave.

5. The extended leave committee will notify the applicant and the superintendent's office of their decision.

Personal Leave

Personal leave will be allowed at the rate of two (2) days per year. This will be non-cumulative. These days will be allowed for any personal business that cannot be handled outside the regular school day. Personal leave may be used for the purposes of sick leave only after all accumulated sick leave has been used. No leave may be taken for vacation or recreational purposes. Use of personal leave for any such purpose may result in disciplinary action.

An employee intending to exercise such leave shall notify the principal or supervisor at least 24 hours in advance, except in the case of an emergency. Unless approved by the superintendent, an employee cannot use personal leave before or after vacations or holidays, or during the first or last week of the school year.

Employees shall complete the appropriate form provided for such absence (see Regulation #4161.2). The completed form shall be filed with the Payroll Department.

Bereavement Days

Bereavement days will be allowed at the rate of six (6) days per year, non-cumulative, for any death as determined by the employee.

Legal Leave

Each employee shall be granted leave when called for jury duty or subpoenaed as a witness. Validation of service must be provided.

If an employee is paid the $50.00 per day from the court after the third day, he/she may:

1. Accept the check from the court with full deduction of pay by the school district, or

2. Be paid his/her regular salary from the school district in which case the employee shall turn over to the Board payment received for such service.

Any exceptions to use of leaves as described in this policy must be approved by the Superintendent.
