4162 Unpaid Family/Medical Leave

The provisions of this policy shall apply to all family and medical leaves of absence except to the extent that paid leaves are covered under other Board policies. If an employee is entitled to paid leave under another policy, the employee shall use such paid leave first. Cumulative leave paid and unpaid shall not exceed 12 weeks total.

An employee shall become eligible for unpaid family/medical leave up to a combined total of 12 weeks annually, providing the following conditions prevail.

1. The employee has been employed by Moffat County School District for at least 12 months.

2. The employee has worked a minimum of 1250 hours during the 12 month period preceding the commencement of the leave.

3. The employee has exhausted all the paid sick leave, paid vacation, and paid personal leave which is available to him/her, this amount to be deducted from the 12 weeks.

The employee is entitled to such leave to provide care made necessary due to one or more of the following conditions.

1. The birth of a child of the employee. The leave may be taken upon the birth and for the first-year care of the child. Entitlement for child care leave shall end after the child reaches one year of age.

2. The placement of a child with the employee for adoption or foster care. The leave may commence at any time within 12 months of the date of adoption or placement. Entitlement for child care leave shall end 12 months after adoption or placement of the child.

3. The serious health condition of a family member (son, daughter, foster or adopted child, stepchild, legal ward) under 18 or incapable of self-care due to physical or mental disability; a spouse; a parent; or individual who stood in loco parentis to employee.

4. The serious health condition of the employee.
