Section 1. Classified employees may be laid off for reasons of (1) lack of work, (2) financial inability of the school district to sustain the job as determined by the superintendent or school board, (3) termination of special funding for the employees, and (4) other reasons deemed appropriate by the superintendent and/or school board. Employees on lay off may continue hospitalization benefits for a period of eighteen (18) months at their own expense while not working for an employer offering access to a group plan.

Section 2. Seniority is hereby defined as continuous employment in the school district from the most recent date of employment. This policy applies only to those employees with two or more years of continuous employment.

A. The most recent date of employment is whichever of the following circumstances first occurs.

1. The date of hire by the school board. Should multiple hirings be made at a school board meeting, the employee listed first in the official school board minutes shall be most senior.

2. The date an employee commences uninterrupted actual work for the school district prior to the school board meeting at which the employee was officially hired.

3. In the case of a substitute employee subsequently hired as a permanent employee, the first day of work as substitute providing there has been no period of time in excess of five (5) consecutive working days in which the employee did not actually work and receive payment from the school district.

B. Except as provided in Section A.3, substitute employees shall not accrue seniority.

C. An employee with seniority under this section, who subsequently receives a reduction in work hours, which cause the employee to no longer qualify for seniority under this section, shall be considered to be laid off. As such, the employee shall be treated in the following paragraph.

Section 3. The school board recognizes that the purpose of seniority is to provide a declared policy as to the order of layoff and recall of employees, insofar as possible, depending on employee’s qualifications. Employees with the least continuous service shall be laid off first. Said employees shall be given two weeks written notice of such layoff by the superintendent or his designee. This procedure shall continue until the least senior employee is laid off. If any opening subsequently occurs, the laid off employee with the most continuous service shall be the first recalled. If a former employee elects not to return to work within one (1) week when recalled the employee shall lose seniority rights. An employee who is properly discharged or resigns shall forfeit seniority and in the event of reemployment, seniority rights shall begin as of the date of his/her reemployment.

Section 4. Effective June 1, 2001 all new employees’ seniority shall be established by job classification. These classifications will be addressed in the regulation of this policy. Employees with the least continuous service in their classification shall be laid off first. All present employees with a hire date prior to June 1, 2001 will have seniority defined as continuous employment in the school district from the most recent date of employment.

Section 5. An employees’ seniority list shall be provided by the school board. The seniority list shall be updated annually.
